Pixel-Ponies is a service provided by JL Studio LLC d/b/a Pixel-Ponies, a North Carolina limited liability company (“we,” “us,” or “our”).
Welcome to Pixel-Ponies. By accessing or using our website and services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
You must be at least 13 years old to use Pixel-Ponies. If you are under 18, you represent that a parent or legal guardian has reviewed and agrees to these terms on your behalf.
You are responsible for maintaining the security of your account credentials. You agree not to share your account with others or create multiple accounts. Display names must not impersonate others or contain offensive content.
You retain ownership of content you submit. By posting content, you grant Pixel-Ponies a non-exclusive license to display it within the platform. You agree not to submit content that is illegal, harmful, or infringes on the rights of others.
All public content must be appropriate for all ages. We use an automated content filter to scan horse names, field names, field values, and public notes for language that is not suitable for all ages. If flagged content is detected, the entry is automatically set to private. You can edit the flagged content and re-enable public visibility at any time. Private notes are never scanned.
Public-facing content must also be written predominantly in English. Our community and moderation team is primarily English-speaking, and we can only keep the community safe if our team is able to review the content that appears publicly. This applies to public user profiles, public horse pages, and community-database submissions. A few words of another language are fine; content written mostly or entirely in another language may be automatically set to private (for profiles and horse pages) or declined (for submissions), with an explanation and the opportunity to edit it. Private content is never scanned for language, and you are always welcome to keep content private.
Some features require a paid subscription. Subscriptions renew automatically unless cancelled. A 30-day grace period applies after a subscription lapses, during which your data is preserved. After 365 days without renewal, your data may be permanently deleted. Refunds, cancellation, plan changes, chargebacks, taxes, and sale finality for all paid products are governed by our Refund Policy, which forms part of these Terms.
You can switch between monthly and annual billing from your Account Settings; a plan change takes effect at your next renewal. We may change subscription prices from time to time; any price change applies from your next renewal date, and we will notify you in advance. Members who moved to Pixel-Ponies from our previous website are automatically moved to our current, lower pricing at their next renewal.
You agree not to: abuse, harass, or threaten other users; attempt to gain unauthorized access to our systems; use automated tools to scrape or collect data; or engage in any activity that disrupts the service. Deliberately attempting to bypass the content filter (including but not limited to character substitution, Unicode manipulation, or splitting words across fields) is prohibited and may result in account restrictions.
Images you upload to Pixel-Ponies are stored on our servers for as long as your account is active. You retain ownership of any images you upload. Upon account deletion, your uploaded images are permanently removed within 30 days.
You can export your personal data at any time from your account settings. Data exports are provided as a single JSON file and include your profile information, horse collection data, image URLs, and preferences. Image files are not included in exports. You can download your images individually from your collection pages at any time.
Free exports are available once every 30 days. Additional exports within 30 days require staff approval. This export feature complies with GDPR data portability requirements (Article 20) and COPPA parental access rights.
We reserve the right to suspend or terminate accounts that violate these terms. If we suspend or terminate your account for a violation, any active paid subscription (Pro and the Image Add-On) is cancelled immediately, and the unused portion of your current billing period is not refunded, except where a refund is required by applicable law. See our Refund Policy for details. You may delete your account at any time through your account settings.
Pixel-Ponies relies on third-party services including Stripe (payment processing), Supabase (database), Cloudflare (security), Discord (authentication and community), Resend (email), and Vercel (hosting). These services have their own terms and privacy policies. We are not responsible for the practices or availability of third-party services. In particular, all payment and billing data is processed by Stripe; we do not store, access, or control your payment card information.
Pixel-Ponies is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee uninterrupted access, that the service will be error-free, or that your data will never be lost. We recommend keeping your own records of any data that is important to you.
To the fullest extent permitted by law, JL Studio LLC d/b/a Pixel-Ponies and its members shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service. Our total liability for any claim related to the service shall not exceed the amount you paid to us in the 12 months preceding the claim.
You may delete your account at any time. Upon deletion, all your personal data, collection entries, and associated content will be permanently removed. Community database contributions you made to the community database will be retained with attribution changed to “[Deleted user].” Account deletion is irreversible.
We respect the intellectual property rights of others. If you believe content on Pixel-Ponies infringes your copyright, please send a notice to support@pixel-ponies.com including: a description of the copyrighted work; the location of the allegedly infringing content on our platform; your contact information; a statement that you believe in good faith the use is not authorized; and a statement under penalty of perjury that your notice is accurate and that you are the copyright owner or authorized to act on their behalf. We will respond to valid DMCA notices promptly.
Pixel-Ponies organizes informal “game spaces” to help users log and track horses from specific games. These game spaces are fan-created and are not official products of or endorsed by any game studio. We make reasonable efforts to clearly communicate this distinction throughout the platform.
Game studios or their authorized representatives may request that we modify or remove a game space from our platform at any time. We respect these requests and will act on them promptly.
If a game space is removed: (a) users will retain any personal data they created, such as horse names, personal notes, and custom fields; (b) community database references, game-specific pre-designed fields, game-specific analytics, and game space sections associated with that game will be disabled; (c) horses previously linked to that game space will remain in users' collections but may lose certain game-specific functionality.
Certain features within game spaces (including but not limited to game-specific analytics, sections, syncing capabilities, and studio-provided content) may not always be available. Feature availability may change without notice due to studio requests, technical limitations, or platform updates. We do not guarantee the ongoing availability of any specific game space or game-specific feature.
Pixel-Ponies Green (PPG) is our primary theme and is designed to meet WCAG 2.1 AA accessibility standards for color contrast, text sizing, and interactive element visibility. PPG is the default theme for all users and serves as the baseline experience.
Additional theme packs available through our marketplace are community-designed visual customizations. While we review theme packs for basic functionality, third-party theme packs may not meet all accessibility standards. Theme packs may contain color contrast ratios below WCAG AA thresholds, decorative animations, or visual effects that could affect users with photosensitive conditions or visual impairments.
By purchasing and applying a non-default theme pack, you acknowledge that the visual experience may differ from our accessibility-tested default theme. You may switch back to Pixel-Ponies Green at any time from your account settings. We reserve the right to update, modify, or remove theme packs that present significant accessibility or safety concerns.
These terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to conflict of law principles. Any disputes arising from or relating to these terms or your use of the service shall be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina. If you are accessing the service from outside the United States, you do so on your own initiative and are responsible for compliance with any applicable local laws. Nothing in these terms shall limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence.
We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the revised terms.
